Ok so I went to the doctor on Monday and he called in a couple injectable medications to give me. He called in 4 of phenergan and 4 of demerol for my migraine's now that i'm pregnant and can't take immitrex. I paid for these medications at the pharmacy with my own money out of my pocket. I now want to take them to a new doctor of my choice but they won't give them to me. Can they legally refuse to give me my meds I paid for?The reason i'm changing doctors is because of insurance. My old doctor is out of network so my insurance wouldn't pay now. They were not willing to release the meds to my new doctor. Even if my new doctor prescribes it for me again I am out the money from the others that is why i'm concerned.

Yes, they sure can.You can ask for your money back..but there is nothing you can do. If they don't feel you need the medication or will be mis-using it they do not have to release it to you..esp injectables..and esp if you are pregnant. They medication they prescribed is prescribed by them..not another dr. If you want to go to antoher doctor than you have that dr prescribe the medication for you.

You want to take the prescribed meds to a new doctor? Why? Maybe he can withhold them since he assumed he'd be able to observe you while you're taking them?? I don't know for sure, but I wouldn't tell them you plan to go to a new doctor.

Yes because they are controlled substances in injectable form, he does not have to give them to you, but he should have to have them shipped to your new MD. You are correct that they belong to you and at the very least they should be sent back to the pharmacy and you should be issued a refund.

without knowing the laid down procedure for injectable medication, in your area, i can only speculateHave you contacted the original,doctors surgery, (the one who prescribed the medication)and asked why you cannot pick the drugs up in the usual way?Can it be that the transfer to another doctor , makes it unethical for your original prescription to be given, without the new docs say so ??As these are prescribed medication ... the only person who can issue them is your current doctor .It seems a great muddle to meand i really do not know how the law stands on this .Be well and congratulations on your new baby.>^,,^<

I would think that your new doctor would be able to talk with the pharmacist if he felt these medications would be safe to use during your pregnancy. Tell your doctor that you would like him to speak to your pharmacist.
